These terms are the agreement between Ninjaneers Pty Ltd (ABN 68 697 870 643, ACN 697 870 643) ("we", "us"), which runs Pickup Line, and the business that signs up for Pickup Line ("you"). You must accept them before your service is switched on. By doing so you agree to them on behalf of your business and confirm that you are authorised to do so. We keep a record of who accepted, when, and which version. You agree to receive these terms and notices electronically in a form you can keep.
These terms include the Acceptable Use Policy, the Data Processing Terms, the Refunds and Cancellation Policy, the Privacy Policy and the Call Recording Notice. If they conflict, the Data Processing Terms prevail on personal information and these terms prevail otherwise.
Pickup Line is an inbound answering service only. We do not support outbound or cold calling, live transfer of calls to a person, or caller verification.
1. The service
Pickup Line answers calls to your business number with an AI assistant, takes a message, and makes the details available to you in your portal and, where enabled, by text message or email to the people you choose. It may also give callers information from the rules and content you supply. We do not guarantee that every call is answered, that every message is delivered, or that the assistant's answers are correct. You must not rely on the assistant for anything where an error could cause serious harm.
Emergencies. Pickup Line is not an emergency service. Where a caller describes immediate danger, the assistant tells them to call 000. An urgent alert to you is a message only. It does not call emergency services or dispatch anyone. You must not use Pickup Line as your only way of receiving emergency calls.
2. Accounts and security
- You must give accurate business details, including your ABN and authorised contact.
- You are responsible for your authorised users and for loss caused by your failure to take reasonable account-security precautions. You are not responsible to the extent loss is caused by our breach, negligence or security failure. Keep credentials private, turn on second-step verification where we offer it, remove people who leave, and tell us promptly if you suspect misuse.
- During the pilot, second-step verification may be deferred under a written risk acceptance that the pilot business signs. Any deferral ends before a second business is onboarded or the service opens to the public, whichever comes first.
3. Permitted use
You may use Pickup Line for inbound customer calls to your own business, in line with the Acceptable Use Policy. You must not use it to:
- break the law, or to mislead or harass callers;
- make outbound or marketing calls or messages, because Pickup Line does not support them;
- collect health or other sensitive information, or card or payment details, through the assistant;
- supply content that is unlawful, defamatory or that infringes others' rights.
We may refuse or remove content, and we may limit or pause a service that creates a legal risk, causes harm, or exceeds agreed limits. We will act reasonably and proportionately, explain the grounds, and give reasonable notice and a chance to fix the problem where practicable. An immediate suspension lasts only as long as reasonably necessary.
4. Recording, AI disclosure and callers
- The assistant announces at the start of every call that it is an AI and that the call is recorded. You must not try to remove, shorten or talk over the announcement, or ignore a caller's objection. A caller who objects to recording is handled as set out in our Call Recording Notice.
- Call recordings may be stored outside Australia, and calls and notes are processed by an artificial intelligence provider through a global service, which may be outside Australia. Our Privacy Policy gives the detail. You must tell your own customers and staff where your own notices require it.
- Your acceptance of these terms is not consent from callers or other people on a call. We are responsible for the platform's recording and processing arrangements. You must obtain any permissions needed from your own staff. Neither of us may use or disclose a recording, or what is derived from it, without a lawful basis.
- Rules about recording calls differ between states and territories, and some require every person on a call to consent.
- Our staff do not listen to recordings or read transcripts except to help with a support request from you or to investigate a security or misuse issue. Calls marked "do not listen or read" are excluded. You agree to this access. We do not use calls to train AI models. Not all of our service providers have confirmed in writing that they do not use call data for training, so we cannot guarantee it for every provider.
5. Your data and our Data Processing Terms
You own the content you give us, such as your rules, business information and contact lists. For caller information that the service collects on your behalf, you decide why and how it is used and we handle it for you, under the Data Processing Terms. We also hold some information for our own purposes, as our Privacy Policy explains.
You promise that you have the right to give us the information you supply, and that you have told your staff and any other people whose details you give us.
6. Plans, fees and billing
Paid plans are not yet available. These billing terms apply from when they are.
- Ring: 60 answered calls per month. A$129 per month. The first paid month is half price, A$64.50 (plan fee only).
- Dial: 150 answered calls per month. A$219 per month. The first paid month is half price, A$109.50 (plan fee only).
- Line: 350 answered calls per month. A$429 per month. The first paid month is half price, A$214.50 (plan fee only).
- Switchboard (Enterprise): for higher volumes or custom needs. By quote, invoiced by arrangement. Contact us for terms. It cannot be chosen in the portal.
- A free trial of 14 answered calls comes first, with no card needed.
- Calls over the included amount are charged at A$2.20 per answered call on Ring, Dial and Line. Top-ups are charged at the same A$2.20 per answered call. The first-month discount applies to the plan fee only.
- What counts as an answered call: a call the assistant answers that lasts at least 15 seconds and from which it takes the caller's details, other than calls identified as spam. Calls under 15 seconds are not counted. The portal shows your usage for the current period.
- Unused included calls roll over for one month, up to the plan's monthly amount. Upgrades are pro-rated.
- All prices are in Australian dollars. We are not registered for GST, so our invoices do not include GST and show "No GST has been charged". If this changes we will give you notice before prices or invoices change.
- Plans are charged monthly in advance by card through our payments provider. If a payment fails we tell you by email and text message and we keep answering and delivering your messages. After 14 days the service switches to message capture only, and we cancel the plan at 30 days if payment is still not made. We never hold your messages back because of non-payment.
- The first-month discount ends at the standard price stated at sign-up. For other changes, we may change fees for the future by giving you at least 30 days written notice. If you do not accept a change, you may cancel before it takes effect and receive a refund of prepaid unused fees. This applies despite the usual cancellation timing.
7. Your consumer rights
Our services come with guarantees under the Australian Consumer Law that cannot be excluded. These include that services are provided with due care and skill and are fit for a purpose you have made known to us. If we fail a guarantee, you are entitled to remedies such as having the problem fixed or a refund, depending on how serious it is. Nothing in these terms removes those rights. Our Refunds and Cancellation Policy is in addition to them.
8. Cancellation, suspension and exit
- You may cancel at any time by writing to us, or from the portal where that option is available. For ordinary cancellation, cancellation takes effect at the end of your current billing period, and you keep the service until then. You may cancel before a change takes effect and receive a refund of prepaid unused fees if you do not accept a fee change, if a change to these terms or a transfer of our business materially disadvantages you, or if we cannot resolve your objection to a new category of provider or a change in where call audio is processed. Cancellation rights under the Australian Consumer Law apply according to that law.
- We may suspend or end the service if you break these terms in a serious way or after notice if you do not fix a lesser breach, if required by law, or if a provider stops supplying us. Where we can, we will give notice and time to get a copy of your data. If we end the service for a reason that is not your breach, we will refund prepaid fees for the unused period.
- On exit, you can ask us for a copy of your call records, summaries, transcripts and configuration, which we prepare manually. Closing your account does not delete your data automatically. When your account closes, or when you ask us, we delete your data manually within 30 days and ask our providers to delete their copies, except where we must keep it for legal reasons. Copies in our database backups remain until those backups expire. Copies already sent to you stay with you.
- After cancellation we hold your phone number for at least 90 days before it is released or reused. Remove call forwarding to your Pickup Line number when you cancel. We remind you before release.
9. Service limits
We may set limits on call volume or spend to protect the service, and will tell you about them. We can pause a number or an assistant immediately if needed to stop abuse or a serious fault.
10. Liability
Nothing in these terms excludes, restricts or modifies any right, guarantee or remedy that cannot lawfully be excluded, restricted or modified, including under the Australian Consumer Law. Each party remains responsible for loss caused by its breach, negligence or other wrongful conduct, subject to applicable law. Nothing in these terms excludes any telecommunications or emergency-call obligation that applies to us.
11. Changes to these terms
We may change these terms for the future by giving you at least 30 days written notice by email. Changes to documents referred to in these terms follow the same process. If a change is materially to your disadvantage you may cancel before it takes effect and receive a refund of prepaid unused fees.
12. Notices and electronic acceptance
Notices to you go to the email address on your account, and we may also show them in the portal. You can contact us by email to [email protected], or for privacy matters [email protected], or by post to PO Box 502, Caloundra QLD 4551. You agree these terms and notices may be given and accepted electronically.
13. Disputes and governing law
Tell us about any dispute in writing and we will try to resolve it within 20 business days. These terms are governed by the laws of Queensland, and the parties submit to the non-exclusive jurisdiction of the courts of Queensland and the Commonwealth sitting there. This does not limit rights you have under law that cannot be excluded.
14. General
These terms and the documents they include are the whole agreement. If one part is unenforceable the rest continues. Neither party may transfer the agreement without the other's consent, except that we may transfer it to a successor of our business with notice, if the successor takes over our obligations. If the transfer materially disadvantages you, you may cancel with a refund of prepaid unused fees. A delay in using a right is not a waiver of it.
